Who Could Be Reading Your E-Mail?

"We think it's a very strained interpretation of the law," Flint said of the appeals court ruling. "I think people understand that their employer has the right to read their work e-mail, but I don't think people have the concept that their personal e-mail is susceptible to being read and used by their ISPs . . . without their consent."

This is the kind of thing The Center for Democracy and Technology keeps an eye on for us.
"A federal appeals court in Boston has ruled that the wiretap laws do not apply to real-time interception of email. The decision potentially creates a loophole for law enforcement access to email, and exposes the inadequacy of current law against ISPs' use of their customers' email for their own business purposes and without notice or consent."
